  1. PokerView Rakeback Offer Added to PAS

    PokerAffiliateSolutions has added the PokerView rakeback offer to the PAS network. PokerView is the world’s only online poker site offering “Webcam Poker,” a truly unique playing experience for online poker players. PokerView is a US-facing site on the Everleaf Network, which also holds an EU license in Malta. Publishers promoting rakeback on PokerView receive 50% commissions -- with 40% going to rakeback for players. The 10% rakeback commission is the highest for an Everleaf room on the PAS network.

    About webcam poker:

    To play webcam poker on PokerView, players must use the browser version of the software. Players must ensure that they have a functioning webcam and that the video and lighting meet PokerView standards for players to continually play on webcam-designated tables. Players signing up at PokerView do not have to participate in the webcam tables; players can also play at any of the standard Everleaf tables as well.

  2. Weekly Industry Update June 25: Barton Bill Introduced, Poland Bans Online Poker

    In the last few days, we have seen some positive developments in the effort to regulate online poker in the United States. Earlier in the week, Rep. Jim McDermott announced his bill to tax online poker in the United States and on Friday Joe Barton introduced a bill to legalize online poker in the country. On the other end of the legalization spectrum, the Polish president has signed a bill banning online poker in Poland.

    Joe Barton Introduces Poker Bill: As expected, Joe Barton introduced the Internet Gambling Prohibition, Poker Consumer Protection, and Strengthening UIGEA Act in Las Vegas on Friday before Event 43 of the World Series of Poker. The Barton bill currently has 11 sponsors and is the first legislation introduced since April 15th. Like other previous legislation, only US players would play against each other. States would be required to "opt-out" if they did not want to have regulated online poker; this would need to be done by the governor of the state. Check out our full write-up on the bill. A companion bill to tax online poker was also introduced by Rep. Jim McDermott (D) earlier in the week.

    Poland Bans Online Poker: It looks like online poker opposition doesn't just come from the United States. Last week, Polish President Bronsilaw Komorowski signed an amendment to a law that would ban online poker in the country. The law would likely go into effect in the next couple months. Sportsbetting will still be allowed, assuming servers are located in the EU and the company has a domain name in Poland. The law is expected to come under pressure from the EU on anti-competitive grounds.

    Cake Switches to .eu Domain Name: On Saturday afternoon, visitors to the Cake Poker website were being redirected to the a new .eu domain name. The site joins an increasing number of US-facing sites that have switched domain names since the events of Black Friday. Bodog has switched to .eu, while other rooms such as Sportsbook, True Poker and Doyles Room have switched to the .ag extension.

  3. Summary of the Barton Online Poker Bill

    U.S. Representative Joe Barton (R-Texas) has announced a bill that would regulate online poker in the U.S. The online poker regulation bill will be introduced to the House Energy and Commerce Committee of which Rep. Barton is a member. The bill’s title is the “Internet Gambling Prohibition, Poker Consumer Protection, and Strengthening UIGEA Act of 2011”.

    Bill Introduction

    The 101-page bill starts by stating that the Unlawful Internet Gambling Enforcement Act of 2006 has only been partially successful. It also states that the law does not make it clear if online poker and other gambling not related to sports are even illegal. It also goes on to describe that the Department of Justice has an opinion that differs from the opinion of the courts and that the law needs to be clear with exactly what is legal and what is illegal, as that would aid law enforcement.

    The bill then states that tools are needed to help law enforcement with identifying illegal gambling websites. A list of unlicensed gambling websites would be compiled by the regulating agencies. This list would include the owners, operators, and key personnel involved with these companies.

    It is then stated that poker is a game of skill and is not comparable to house games. It goes on to state that online poker should be clearly legal and casino and sports betting should be clearly illegal. U.S. consumers would benefit by having consumer protections to help prevent fraud, underage gambling, problem gambling and unlawful uses of online poker money. All of this could be done while creating a new industry in the U.S. that would create thousands of jobs. While the bill mentions tax revenue it fails to mention any tax rates.

    Government Oversight

    The Department of Commerce would create a department that would oversee state licensing agencies. This new department would be called the Office of Internet Poker Oversight. This department would create the regulations that states must adhere to if they decide to participate in online poker. The state agencies would have to come up with responsible gambling programs that may include self-exclusion, deposit limits and information on where to get help with a gambling problem. Players that self exclude themselves or get banned would have all money forfeited to the government agency that handled the exclusion or ban. The states would also decide what companies to license in their state. Only experienced casino operators could be licensed in the first two years. Applicants and their directors cannot have a conviction of a crime that carries a punishment of over one year in jail.

    States and Reservations could opt out. This can be done by the state governor or tribal leader. States must opt out to be excluded. A notice of 60 days must be given if a state decides not to participate in online poker.

    Laws Affecting Players

    Other regulations include a minimum age of 21 to play, a ban on delinquent child support parents and a ban on credit cards. While credit cards would not be allowed under this law it would be very likely that a player could use an electronic check, a cash deposit at a casino, bank wire, debit cards, ewallets such as Paypal and countless other options. It would seem the point of that requirement is to try to keep people from borrowing money to play online poker.

    The bill also mentions that this does not override any existing legal online gambling. This means that this bill would not apply to the Washington D.C. online gambling law that has already passed. It would also not affect online state lotteries, online horse racing, online fantasy sports wagering and Nevada online and mobile sports betting. It also would not apply if states pass their own online gambling laws before this bill may pass.

    Poker net cafes would be illegal under this bill. Anybody that runs a brick and mortar establishment that specializes in providing online poker players with a computer and connection to play could be fined and sentenced to up to 5 years in jail. Cheating, colluding and the use of bots is punishable by a fine and up to 3 years in jail. Any player caught cheating in any way would be permanently banned from online poker. Government agencies would share information about banned and excluded players.

    Poker tracking software is not specifically mentioned. There is a section that describes what is and is not allowed. From reading that section it is clear that any software, even bots, would be allowed on play money tables. It seems to me that tracking software that is widely accepted as legal today would still be allowed but would require a license issued by one of the governing agencies.

    Unlicensed Online Poker Companies

    Companies that operated in the U.S. after this law passed without a license would end up on a rogue list. These operators would be contacted by the Office of Internet Poker and told of their violation of this law. The operators would be given the opportunity to plead their case before the U.S. District Court in Washington D.C. which would be the court that would hear all cases related to this law. A company or person that is found guilty of operating an unlicensed gambling website in the U.S. is subject to a $1,000,000 a day fine or the total amount wagered, whichever is greater.

    Online poker companies that wish to operate in the U.S. that at some point operated illegally would be evaluated on a case by case basis. The time the company stopped accepting U.S. players would be considered when deciding if they qualify for a license. The bill mentions nothing about ring fencing U.S. players. It seems companies that operate online poker websites around the world would be granted a license under the current language of this bill.

    Vendors

    Vendors would not need to be licensed by any agency. Vendors would have to be disclosed to the Office of Internet Poker or a state agency. A background check would be run on these vendors and payments made to these vendors would be reported. While the bill is not extremely clear who vendors are it seems likely this would mean affiliates, payment processors, software providers, customer service providers and any other person or company that is involved in the day to day operations but is a third party provider of the service.

    Author Notes

    This bill is 101 pages long. It was at points repetitive and at some points unclear where the reader had to draw a conclusion from the information given. It is extremely likely any bill that may pass will look much different than the bill Rep. Joe Barton has announced. At the very least tax rates need to be addressed. This bill is far from a sure thing but this is the first online poker bill that has been announced since Black Friday. It is likely members of Congress are aware now more than ever that it is time to do something about the online poker problem in the U.S.
  4. Cake Poker Moves to .EU Domain

    As of Saturday afternoon, visitors who go to cakepoker.com will be redirected to the new cakepoker.eu web address. The site joins other US-facing poker rooms such as Bodog that have switched their domain names from .com to .eu. The move by Cake Poker and others is presumably a precaution in light of the April 15th domain name seizures of PokerStars, Full Tilt Poker, Absolute Poker and UB, dubbed "Black Friday" by members of the poker community. There has been no announcement from Cake Poker at the time of this writing.

    Shortly after the “Blue Monday” seizures, which saw an additional 11 domain names seized by the US Department of Justice, Bodog became one of the first rooms to switch to the .eu domain name. Poker players that went to the new site were greeted with a hybrid of a US and Euro flag, an indication that intend to accept players from both jurisdictions. True Poker and Doyles Room, which were two of the Blue Monday affected rooms, continued to operate and accept US players under the .ag domain name. It’s safe to say more rooms are likely to follow suit in the coming weeks

    At this time, Cake Poker affiliate links appear to be correctly redirecting to the .eu domain name. Since this move was done on a Saturday, we will likely not have full information regarding any changes that need to be made concerning affiliates until next week. We will be sure to act promptly and pass on any new information that we receive.

    There are two huge Bad Beat Jackpot opportunities right now in the online poker world. The players that hit these jackpots will win money that will change their lives.     Boss Media Bad Beat Jackpot

    The Bad Beat Jackpot promotion on the Boss Media Network, also known as the International Poker Network, will set an online poker bad beat jackpot record when their jackpot is hit. Currently the bad beat jackpot is €910,000 which is about $1,300,000.

    For a player to win the bad beat jackpot on Boss Media they must lose four of a kind 10's or better. Both the winning and the losing player must use both hole cards. Any four of a kind hand must be a pocket pair. If one or both hands is a straight flush both hole cards must be used in that straight flush. Players must be playing on a Bad Beat Jackpot table with four or more players where a €.50 jackpot drop has been taken from the pot. The player that loses the hand gets 35% of the Bad Beat Jackpot, the player that beats them gets 17.5% of the Bad Beat Jackpot and 17.5% of the Bad Beat Jackpot is divided among all of the players dealt in the hand. 20% goes towards the next Bad Beat Jackpot and 10% goes to the house.
